Help Desk: Does a tenured teacher get the 75 days of pay and benefits if cancellation is because of reduction in force?

Help Desk: Does a tenured teacher get the 75 days of pay and benefits if cancellation is because of reduction in force?
No.

A layoff caused by a reduction in force is distinguishable from a termination caused by one of the statutory grounds. Refer to the language in Alabama's Students First Act regarding the 75 days of pay:

“...a decision to terminate...shall be effective immediately, except that a tenured teacher...shall continue to receive pay and benefits until a final ruling by the hearing officer or 75 calendar days, whichever occurs first from the date of the employer termination decision...” Section 6(m).

There is no final ruling by the hearing officer for a layoff, so this section does not apply.
